Terms and conditions
Version: October 2026
Section 1 Scope
These general terms and conditions (the "Terms") apply to all contracts between Sun Media Brands LLC, 2880 W Oakland Park Blvd, Suite 225C, Oakland Park, FL 33311, USA (the "Provider") and consumers, meaning individuals who act for purposes that are predominantly outside their trade or business, regarding the digital content and services offered on the website albertaclass7practicetest.ca.
The contracting party and seller is the Provider. Payment is processed by the payment service provider Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Dublin, Ireland ("Stripe"). Access to the trainer and all services from it are provided by the Provider.
Conflicting terms of the customer are not recognized unless the Provider has expressly agreed to their validity in writing.
Section 2 Subject matter of the contract
The subject matter of the contract is online access to an exam preparation trainer (practice questions with answers, practice exams, learning progress tracking). Depending on the offer, access is provided as a subscription or as a one-time paid, lasting access. Scope, term and price are shown on the order page. Prices are shown and charged in US dollars (USD) or Canadian dollars (CAD), as displayed at checkout.
The service is not an official offering and does not replace the exam. The Provider is not affiliated with any government agency or testing body. Passing an exam is not guaranteed.
Section 3 Conclusion of the contract
The presentation of the products on the website is not a legally binding offer but an invitation to place an order. When an offer is selected, the Stripe checkout page opens. By completing the payment there, the customer submits a binding offer. The purchase contract with the Provider is concluded as soon as the Provider activates access and confirms this by email.
Section 4 Prices and payment
The current price is shown on the order page. The price displayed at checkout is the price charged, including any applicable taxes shown there.
Payment is made using the payment methods offered on the Stripe checkout page. The purchase price is due immediately upon conclusion of the contract. For a subscription, the price is charged at the start of each billing period to the registered payment method.
Section 5 Provision of the service
After receipt of payment, access is usually activated immediately. No physical delivery takes place. The one-time paid lasting access has no term and no renewal, for as long as the Provider operates the trainer for the relevant exam. A subscription renews each time for the chosen billing period and can be cancelled at any time with effect at the end of the current billing period, either in the account under "Manage or cancel subscription" or by email to [email protected]. Access remains available until the end of the paid period.
Section 5a Money-back guarantee
In addition to the statutory rights, which this guarantee does not limit, the Provider gives the following voluntary guarantee: If the customer does not pass the knowledge exam that the trainer prepares for, the Provider refunds, for a subscription, the most recent payment and, for a one-time paid lasting access, the price paid.
The conditions are that a paid access existed on the day of the exam and that the customer sends proof of the failed exam by email to [email protected] no later than 30 days after the exam date (for example a photo or copy of the exam result). The guarantee applies once per customer. The refund is made via Stripe to the original payment method. With the refund of the one-time price, the lasting access ends; a subscription continues until it is cancelled.
Section 6 Right of withdrawal and early expiry
Consumers have a statutory right of withdrawal where applicable. Details are set out in the refund and withdrawal information.
Important note on early expiry: For contracts for the supply of digital content, the right of withdrawal expires if the consumer has expressly agreed that the Provider begins performance of the contract before the withdrawal period ends and has confirmed that the consumer is aware that this consent causes the loss of the right of withdrawal. By completing the order, the customer gives this express consent.
Section 7 Defects
The statutory rights in case of defects apply. In case of defects, the customer can demand remedy. If this fails, the customer can, under the statutory rules, demand a proportionate price reduction or terminate the contract.
Section 8 Liability
The Provider is liable without limitation for damage resulting from injury to life, body or health and for damage caused intentionally or by gross negligence. In case of simple negligence, the Provider is liable only for breach of essential contractual obligations and limited to the typical, foreseeable damage for this type of contract.
The content has been compiled with care. Liability for the accuracy, completeness and timeliness of questions and answers, and for passing an exam, is excluded within the limits of the preceding paragraph.
Section 9 Data protection
Information on the processing of personal data can be found in the privacy policy.
Section 10 Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Section 11 Final provisions
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the state or province where the consumer has their habitual residence.
Should individual provisions of these Terms be invalid, the validity of the remaining provisions is not affected.
